3. HOW WE USE YOUR INFORMATION
We use your information responsibly and only for purposes that benefit your health tracking experience. Here's a detailed explanation:
3.1 App Improvement and Analytics
Performance Monitoring:
- We analyze technical data to understand how quickly the App loads on different devices, which features cause crashes or errors, connection stability between phones and hand bands, and battery consumption patterns.
- This helps us identify and fix bugs, optimize code for better performance, and ensure compatibility with various phone models and operating systems.
User Experience Research:
- We study how users navigate through the App to understand: which features are most popular and valuable, where users encounter confusion or difficulty, which workflows are intuitive versus problematic, and what features are rarely used and might need redesign.
- This research is conducted using aggregated, anonymized data - we look at patterns across all users, not individual behavior.
Feature Development:
- Usage patterns inform our product roadmap. If many users frequently access sleep analysis, we might prioritize more advanced sleep features. If few users engage with a particular feature, we might reconsider its design or placement.
- We test new features with small user groups before wider release, analyzing feedback and metrics to refine functionality.
Accuracy Improvements:
- We continuously work to improve the accuracy of health tracking by: analyzing patterns in sensor data, comparing algorithm outputs against known benchmarks, identifying factors that affect measurement quality, and updating calculation methods as we learn more.
- Your anonymized data may contribute to research that improves tracking accuracy for all users.
3.2 Communication with You
Account and Service Communications:
- Essential Notifications: We send important messages about your account, such as successful registration confirmation, password reset instructions, account security alerts (unusual login attempts), changes to our Terms of Service or Privacy Policy, and service interruptions or maintenance schedules.
- Transactional Emails: Confirmations of actions you have taken, like changing settings, exporting data, or deleting information.
- These communications are essential to the service and cannot be opted out of while maintaining an active account.
Customer Support:
- When you contact us with questions or problems, we use your information to understand your issue in context, access your account details (with proper authentication), troubleshoot technical problems, provide personalized assistance, and follow up to ensure resolution.
- Support interactions may be recorded for quality assurance and training purposes.
Product Updates and Feature Announcements:
- With your consent, we may inform you about new features added to the App, updates that improve functionality or security, tips for getting more value from Skofit, and seasonal health challenges or campaigns.
- You can opt out of these promotional communications at any time while still receiving essential account emails.
Health and Wellness Content:
- We may send educational content about: general health and fitness topics, tips for better sleep or more activity, seasonal health advice (e.g., staying active in winter), and explanations of your health metrics.
- This content is educational, not medical advice, and can be disabled in settings.
3.3 Legal Compliance and Safety
Regulatory Compliance:
- We process your data as necessary to comply with Indian laws, including the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, the Information Technology Rules, 2011, the Consumer Protection Act, 2019, and other applicable regulations.
- We maintain documentation and implement safeguards required by these laws.
Security and Fraud Prevention:
- We monitor for suspicious activity such as unusual login patterns that might indicate account compromise, multiple failed login attempts suggesting hacking attempts, data access patterns inconsistent with normal use, and attempts to exploit vulnerabilities in the App or system.
- Security measures include automated systems that flag anomalies and manual review when necessary.
Legal Obligations:
- We may process your data when required by law, such as responding to valid subpoenas or court orders, cooperating with law enforcement in legitimate investigations, reporting information as required by health regulations, and participating in audits by regulatory authorities.
- We carefully review all legal requests and only provide the minimum information legally required.
4. DATA STORAGE AND SECURITY
Your health data security is paramount. Here is exactly how we protect your information:
4.1 Where Your Data is Stored
- Local Storage on Your Device:
- Primary Storage Location: Most of your health data is stored directly on your smartphone or tablet in a secure, encrypted database that only the Skofit App can access.
- Why Local Storage: This approach ensures your data is immediately available even without an internet connection, faster access to your information, reduced dependency on external servers, and enhanced privacy since data stays on your device.
- Local Encryption: Even on your device, data is encrypted using industry-standard encryption protocols. This means if someone gains physical access to your phone, they cannot read your Skofit data without proper authentication.
- Storage Space: Health data is lightweight, typically just a few megabytes, even with months of tracking history.
- Hand Band Device Storage:
- Temporary Storage: Your Skofit hand band stores recent health data temporarily (typically the last 7-14 days, depending on storage capacity).
- Purpose: This temporary storage ensures you don't lose data if your phone is out of range. When reconnected, the Device syncs all stored data to your phone.
- Device Security: Data on the Device is also encrypted and protected by secure pairing - only your authenticated phone can access it.
- Data Deletion: When the Device's storage fills up, the oldest data is automatically deleted after successful sync to your phone.
- Access Controls and Authentication:
- Multi-Layer Authentication: Account access requires your email/username and password combination.
- Internal Access Restrictions:
- Only essential personnel have access to systems containing user data, and access is granted on a "need-to-know" basis.
- All internal access is logged, monitored, and regularly audited.
- Employees undergo background checks and sign strict confidentiality agreements.
- Access credentials are regularly reviewed and revoked when no longer necessary.
- Session Management:
- Active sessions automatically expire after periods of inactivity to prevent unauthorized access if you leave your phone unlocked.
- You can remotely log out of all devices from account settings.
- We maintain logs of active sessions so you can see where you're logged in.
- Secure Bluetooth Pairing:
- Pairing Process: When you first connect your hand band to the App, a secure pairing process establishes encrypted communication.
- Unique Pairing Keys: Each Device-phone pair uses unique cryptographic keys that are never shared with other devices.
- Protection Against Eavesdropping: BLE security prevents nearby Bluetooth devices from intercepting your health data.
- Verification: The App verifies the Device's authenticity to protect against counterfeit devices attempting to capture data.
- Incident Response:
- Monitoring: Our security team monitors systems 24/7 for potential breaches or anomalies.
- Response Plan: We maintain a detailed incident response plan that outlines steps to take if a security breach occurs.
- User Notification: In the unlikely event of a data breach affecting your information, we will notify you promptly in accordance with applicable laws, typically within 72 hours of discovery.
- Remediation: We will take immediate action to contain breaches, assess impact, and implement fixes to prevent recurrence.
4.3 Data Retention: How Long Do We Keep Your Data
- Active Accounts:
- Account Information: Your profile, settings, and preferences are maintained throughout your account lifetime.
- Activity Logs: Technical logs (like sync history) are typically retained for 90 days for troubleshooting purposes, then automatically deleted.
- Account Deletion:
- User-Initiated Deletion: You can delete your account at any time from the App settings or by contacting support.
- Deletion Process: Within 30 days of account deletion request, we permanently remove: all personal health data, account information and profile details, preferences and settings, sync and activity logs, and backup data from cloud servers.
- Irreversible Process: Account deletion is permanent and cannot be undone. We recommend exporting your data before deleting your account if you want to keep records.
- Legal Retention: In rare cases, we may retain certain information for longer if required by law (e.g., financial records for tax purposes, data related to legal disputes).
- Inactive Accounts:
- Definition: If you don't log in for an extended period (typically 24-36 months), your account may be considered inactive.
- Notification: Before taking action, we'll send emails to your registered address warning that your account is inactive.
- Grace Period: You'll have at least 90 days to log in and keep your account active.
- Deletion: If there's no response, we may delete inactive accounts to free up resources and reduce unnecessary data storage, following the same deletion process described above.
- Legal and Regulatory Requirements:
- We comply with data retention requirements in various jurisdictions, which may mandate minimum or maximum retention periods for certain types of data.
- Health data retention follows medical record standards where applicable.
5. DATA SHARING AND DISCLOSURE
We want to be completely transparent about when and why we might share your information. Your trust is important to us.
5.1 We Do NOT Sell Your Data
- Absolute Commitment:
- We have never sold personal health information to third parties.
- We will never sell your personal health information to third parties in the future.
- We do not allow third parties to use your health data for their own advertising or marketing purposes.
- We do not participate in data broker arrangements where your information would be sold or traded.
- What This Means:
- Your health data is yours alone. We don't profit by selling it to insurance companies, pharmaceutical companies, advertisers, data aggregators, or any other third parties.
- We are committed to this principle regardless of business opportunities that might arise.
5.2 Limited Data Sharing
We share your information only in specific, limited circumstances where it benefits you or is legally required:
With Your Explicit Consent:
- Healthcare Provider Sharing:
- You may want to share your health data with your doctor, physical therapist, nutritionist, or other healthcare providers.
- How It Works: You can share your health information only verbally.
- Alternative: Some healthcare systems may integrate directly with Skofit. If you authorize such integration, your data can automatically sync to your medical records.
- Your Control: You decide what data to share, when to share it, and can stop sharing at any time.
- Family and Friends Sharing:
- You may choose to share certain health achievements or progress with family members or friends for motivation and support.
- What Can Be Shared: Typically, achievements, workout summaries, or progress toward goals - never raw health metrics without your explicit permission.
- Social Features: If we offer social features, you control your visibility and can choose between private, friends-only, or public settings for different data types.
5.3 Legal Requirements and Court Orders
We may be legally compelled to share information in specific circumstances:
A. Valid Legal Process:
- Subpoenas: Court orders requiring us to produce information in legal proceedings.
- Search Warrants: Law enforcement requests backed by judicial authorization.
- Court Orders: Direct orders from judges in civil or criminal cases.
- Regulatory Requests: Demands from health regulators or data protection authorities within their jurisdiction.
B. Our Response Process:
- We carefully review every legal request to ensure it is valid and properly authorized.
- We provide only the minimum information legally required.
- We challenge overly broad or inappropriate requests when possible.
- Where legally permissible, we notify affected users before complying with requests so they can seek legal counsel.
- We publish transparency reports [if applicable] disclosing the number and types of legal requests we receive.
A. Preventing Harm:
- If we have a good faith belief that disclosure is necessary to prevent imminent physical harm to someone, we may share relevant information with law enforcement or emergency services.
- Example: If a user's health data suggests a medical emergency and they're unresponsive, we may share information to facilitate emergency response.
B. Protecting Our Rights:
- If necessary to protect Skofit's legal rights, such as enforcing our Terms of Service, defending against legal claims, protecting our intellectual property, or investigating Terms of Service violations.
C. Fraud Prevention:
- Sharing information with fraud detection services to prevent account takeovers, payment fraud, or other malicious activities.
- This involves primarily technical data (IP addresses, device IDs), not health data.
D. Business Transfers: If Skofit is acquired by another company, merges with another business, or sells substantially all of its assets, your information may be transferred to the new entity.
Your Protections:
- We will notify you via email and a prominent app notice before any such transfer occurs.
- The new entity must continue to honor this Privacy Policy for data collected prior to the transfer.
- You will have the option to delete your account and data before the transfer is completed if you don't wish your information to be transferred.
- If the new entity plans to use your data in materially different ways, it must obtain your consent or allow you to opt out.
6. YOUR RIGHTS AND CHOICES

- How It Works: This is similar to the update right but specifically addresses situations where incorrect data may have been collected due to technical errors.
- Our Responsibility: If we discover inaccuracies in the data we collected, we proactively correct them and notify you.
7. BLUETOOTH (BLE) AND DEVICE PERMISSIONS
7.1 Bluetooth Permission and Usage
Why Bluetooth Access is Required: The Skofit App fundamentally depends on Bluetooth Low Energy (BLE) technology to communicate with your hand band. Without Bluetooth access, the core functionality of the App cannot work.
What We Do With Bluetooth:
- Device Discovery and Pairing:
- When you open the App for the first time, it scans for nearby Skofit hand bands to pair with.
- The scanning process detects Bluetooth devices broadcasting the Skofit signature.
- You select your specific device from discovered options.
- A secure pairing process establishes encrypted communication between your phone and hand band.
- Real-Time Data Synchronization:
- Once paired, your hand band continuously or periodically transmits health data to your phone via Bluetooth.
- Heart rate, steps, sleep data, and other metrics are transferred automatically when devices are in range.
- Synchronization happens in the background, so your data stays current without manual intervention.
- Device Management:
- Check the hand band battery level.
- Update hand band firmware when improvements are available.
- Adjust device settings (display brightness, notification vibration patterns).
- Monitor connection status and signal strength.
- What We DON'T Do With Bluetooth:
- We do not scan for or connect to non-Skofit Bluetooth devices.
- We do not access data from your Bluetooth headphones, speakers, car systems, or other paired devices.
- We do not track your location using Bluetooth beacons or proximity to other Bluetooth devices.
- We do not use Bluetooth to communicate with other apps on your phone.
- Bluetooth Privacy and Security:
- Encrypted Communication: All data transmitted via Bluetooth is encrypted using BLE security features.
- Pairing Authentication: Only your authenticated phone can connect to your hand band after initial pairing.
- Range Limitation: Bluetooth works only within approximately 10 meters (30 feet), limiting exposure.
- No Internet Requirement: Bluetooth sync works offline; data isn't transmitted over the internet during sync.
- Managing Bluetooth Permission:
- Android: Settings → Apps → Skofit → Permissions → Nearby Devices/Bluetooth → Allow
- Revoking Permission: If you revoke Bluetooth access, the App cannot sync with your hand band, but you can still view previously synced data on your phone.
7.2 Other Device Permissions
The App may request additional permissions to provide full functionality. Here's what each permission does and why we need it:
Location Permission:
- Why We Request It:
- Bluetooth on Android: Android requires location permission for Bluetooth scanning (this is an Android system requirement, not our choice).
- Privacy Options:
- "While Using App": GPS tracks only during active workout sessions (recommended).
- "Always": Enables background GPS for automatic workout detection (optional, uses more battery).
- "Never": No GPS features, but all other app functionality works normally.
- You Can Disable It If: You don't use GPS-based activity tracking or prefer indoor workouts only.
Storage Permission:
- Why We Request It:
- To save exported health data files to your device storage.
- To store profile pictures locally.
- To cache data for faster app loading and offline access.
- How We Use It:
- Writing files only to app-specific directories.
- Storing only Skofit-related data, never accessing your photos, documents, or other apps' files.
- Reading only files you explicitly select (when importing data or choosing profile pictures).
- What We Don't Do:
- We don't scan your entire phone storage.
- We don't access personal photos, videos, or documents without your explicit selection.
- We don't upload your files to our servers unless you specifically request it (like selecting a photo for your profile).
Camera Permission:
- Why We Request It:
- To take or select profile pictures.
- To scan QR codes for quick device pairing (some hand band models).
- Potential future feature: Scanning food barcodes for nutrition tracking (if we add this feature).
- How We Use It:
- Only when you tap "Take Photo" or "Scan QR Code."
- Camera activates only during these specific actions, not running in the background.
- Photos are processed locally on your device.
- You Can Disable It If: You don't want a profile picture or prefer manual device pairing without QR codes.
Notifications Permission:
- Why We Request It:
- To send health alerts (unusual heart rate, irregular sleep patterns).
- To remind you to move, hydrate, or go to bed.
- To celebrate when you reach goals or complete challenges.
- To alert you about device issues (low battery, lost connection).
- How We Use It:
- Sending notifications based on your health data and preferences.
- Respecting quiet hours and frequency limits you set.
- Never sending spam or excessive notifications.
- Granular Control:
- Enable only specific notification types.
- Set schedules for when notifications can appear.
- Adjust frequency from real-time to daily summaries.
- You Can Disable It If: You prefer checking the app manually rather than receiving proactive alerts.
